1. Participant(s) has voluntarily applied to participate in Elevation Science’s 2025 Field Expedition (“Field Expedition”). Participant(s) acknowledges and voluntarily accepts the risks of participation in this program, including injury and death. Participant(s) understands they may encounter hazardous conditions during the Field Expedition, including, but not limited to: extreme weather temperatures and conditions, work along steep slopes where there is a risk of slipping and falling, strenuous excavation work, hostile wildlife, and large cacti, rocks, and extremely hard soils which may cause injury if protective footwear and gloves are not worn. *

2. In consideration for permission to participate in the Field Expedition, Participant(s) release, hold harmless and agree to indemnify Elevation Science leadership, officers, agents, assigns, parent, subsidiaries and affiliates, directors, managers, employees, and representatives, corporations or other entities, trustees, or their relatives, the landowners, or any participating academic institution or museum and its personnel from all causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reasons of any injury to person or property, including injury resulting in death, which has been or may be sustained by Participant(s) or for which Participant(s) may be liable to another person or as a result of participation in the Field Expedition, notwithstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of Elevation Science or its employees, agents, servants, invitees, co-members, contractors, or subcontractors. *

3. Participant(s) agrees that I/we are fit to participate and suffer from no physical or psychological disabilities which would limit participation in the Field Expedition. Participant(s) agree to notify Elevation Science Expedition leadership, prior to Participant(s) arrival, of any pre-existing medical conditions, including but not limited to asthma, heart conditions, or allergies that could be exacerbated by the rigors of the outdoor activities. Participant(s) carry any necessary first aid supplies, as Elevation Science will not provide them for the participants. I further agree and warrant that all of the personal medical information provided in this document is accurate and complete. *

4. Participant(s) agrees that I/we are responsible for Participant(s) own medical and liability insurance coverage. Participant(s) acknowledges that Elevation Science has not and will not render any medical services, including medical diagnosis of any physical or mental condition during the Field Expedition. Participant(s) understands Elevation Science does not provide any type of medical or liability insurance to cover any possible injuries and accidents during the Field Expedition and/or the scheduled activities. Participant(s) provide proof of insurance to the leadership of Field Expedition if requested. *

5. Participant(s) understand that Elevation Science does not provide any insurance for Participant(s) personal vehicles. Participant(s) agrees to assume all responsibility and holds harmless and indemnifies Elevation Science leadership, agents, assigns, parent, subsidiaries and affiliates, directors, managers, employees, and representatives, corporations or other entities, trustees, or their relatives, the landowners, or any participating academic institution or museum and its personnel rom all causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reasons of any injury to person or property or for which Participant(s) may be liable to another personas a result of travel during this Field Expedition including travel to and from the field expedition. *

6. Participant(s) understands that the registration fees are refundable, minus a $100 fee, through April 30, 2025, after which no payments are refundable. Participant(s) understands that in the event that I am unable to receive a refund, I may elect to either: A. Apply my payment(s) to a future field expedition, or; B. Make my payment(s) tax deductible donations to Elevation Science. Participant(s) understands that the registration fees will cover the costs of the meals and lodging, course materials, necessary equipment needed for the scheduled activities, and transportation to/from the airport and to all field sites. Participant(s) understand that these fees do not cover the costs of transportation from the Participant(s) home to the Billings, MT airport or vice versa. *

7. Participant(s) will be responsible for bringing Participant’s own gear such as: water bottles, a backpack, personal first aid kit, proper clothing, and anything deemed necessary for the harsh environmental conditions that may be encountered. Participant(s)must transport all of these items during the scheduled activities. THESE ITEMS ARE MANDATORY FOR ALL ATTENDEES. *

8. Participant(s) understands that firearms of any kind are strictly prohibited in my possession at any time throughout my participation in the 2025 Field Expedition. Participant(s) further understands that firearms of any kind are prohibited at the Yellowstone-Bighorn Research Association, at any of Elevation Science's field sites, and within vehicles operated by Elevation Science. *

9. Participant(s) understands that the activities of Elevation Science and its leadership are important scientific studies and my participation is a privilege. Participant(s) is prohibited from collecting fossil specimens for personal use unless otherwise authorized by Elevation Science leadership. As such, Participant(s) agrees that the locations, scientific information, and other data that is gathered are the property of Elevation Science. Participant(s) will not disclose any information pertaining to the sites without expressed written consent of Elevation Science leadership. Participant(s) agrees not to generate any written content for publication in any medium, whether electronic or physical,about the activities of Elevation Science without written consent and approval by Elevation Science. Participant(s) fully understands and agrees not to utilize any information obtained by my/our participation in Elevation Science for personal monetary gain. *

10. Participant(s) agrees that as adult parent(s) or guardian of minor children participating in the Field Expedition, that Participant(s) will be required, at all times, to supervise the child and ensure that the child will conduct themselves in a safe and responsible manner, and not disrupt the activities of Elevation Science. I hereby agree to release and hold harmless Elevation Science leadership, agents, assigns, parent, subsidiary and affiliated corporations or other entities, trustees, relatives, landowners, and/or any participating academic institution or museum and its personnel from all causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reasons of any injury to person or property that may be sustained by the child in my supervision or for which the child may be liable to another person. *

11. Participant(s) permits Elevation Science to use my likeness in a photograph, video, or other digital media in any and all of its publications, including web based publications, without payment or other consideration. *

12. Participant(s) agrees not to litter or deface the area(s) in which we are working or staying. *

13. The overall leadership for Elevation Science lies with the Executive Director, Mr. Jason Schein, who is the individual assigned decision-making authority for Elevation Science. Should he determine, in his sole discretion, that the removal of certain individual(s) is warranted for the best interest of Elevation Science, he may do so at any time. Should this action occur, these individual(s) will be asked to leave and will subsequently not receive any reimbursement for the unused portion of their registration fees. *

14. Release and Assumption of the Risk: I am aware and understand that the activities involved in the Expedition require me to have close contact with other individuals as well as surfaces touched by those individuals. This includes, but is not limited to, sharing bathrooms, sleeping in close quarters, group travel, and sharing tools. I UNDERSTAND THAT ENGAGING IN ACTIVITIES AS PART OF THE EXPEDITION, WHETHER EXPRESSLY MENTIONED HEREIN OR NOT, MAY PUT ME AT INCREASED RISK OF CONTRACTING SARS CoV-2 (“COVID-19”) WHICH MAY CAUSE SERIOUS ILLNESS OR DEATH. I UNDERSTAND AND AGREE THAT RELEASEES (AS DEFINED BELOW) CANNOT REASONABLY BE EXPECTED TO KNOW WHETHER OR NOT AN INDIVIDUAL ENGAGING IN THE FIELD EXPEDITION IS INFECTED WITH COVID-19 AND THEREFORE CANNOT GUARANTEE MY PROTECTION FROM COVID-19. I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE EXPEDITION WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED WITH REGARD TO THE POTENTIAL FOR EXPOSURE TO AND CONTRACTING COVID-19. I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF ILLNESS OR DEATH WITH REGARD TO COVID-19 AND ANY SIDE EFFECTS OF OR COMPLICATIONS, IN ANY WAY RELATED TO COVID-19. Participant(s) hereby expressly waives and releases any and all claims, now known or hereafter known, in any jurisdiction throughout the world, against Elevation Science and its officers, employees, agents, representatives, affiliates, shareholders, successors and assigns (collectively, “Releasees”) in any way arising out of or attributable to COVID-19 . This release includes, but is not limited to, a release of any and all claims arising out of or in any way attributable to the negligence of Elevation Science. *

15. Participant Rules and Obligations: In an effort to ensure the health and safety of myself as well as the Expedition staff, and other participants, Participant(s) is required to comply with the following rules and obligations: 1. I will not travel to, nor participate in, the Expedition if I am experiencing, or have experienced within 14 days of my planned arrival date, any of the symptoms of COVID-19 or the flu. Symptoms include, but are not limited to, fever, cough, runny nose, shortness of breath or chest tightness. 2. If I have tested positive for COVID-19 within 14 days prior to the Expedition, I understand that I will be required to submit a letter from my health care provider certifying that I have subsequently tested negative for COVID-19 and I am considered to be fully recovered. I am aware that if I do not provide this letter I will not be allowed to participate in the Field Expedition. 3. I understand that if I cannot participate in the Field Expedition for reasons in any way related to COVID-19, I will not be eligible to receive a refund if the nonrefundable deadline has passed. *

16. Participant(s) agrees to defend, indemnify, and hold harmless Elevation Science Against any and all losses, damages, liabilities, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, arising out of or in any way related to or resulting from my failure to abide by the participant rules and obligations herein. *

17. This Agreement and the 2025 Field Expedition Participant Waiver of Liability and Terms,constitute the sole and entire agreement between Elevation Science, and Participant(s)with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without giving effect to any choice or conflict of law provisions. *

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ELEVATION SCIENCE. *
